Terms of Service

These Terms of Service ("Terms") govern your use of The Rock God ("Rock God", "we", "us", or "our") — the music discovery service offered via our web app, progressive web app (PWA), and any related interfaces (collectively, the "Service"). Please read them carefully before you create an account or use the Service.
1. Acceptance of these Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you personally and that organization.
You must be at least **13 years old** to use the Service. If you are under 16 and live in the EU, you must have a parent's or guardian's consent.
2. Description of the Service
The Service helps you discover new music by analyzing artists or songs you tell us you enjoy and recommending similar artists and tracks pulled from Last.fm and (when you connect them) your streaming services. You can:
- Generate **recommendation sessions** as a guest (up to five inputs per session, up to five sessions per day) or as a registered user.
- **Connect streaming services** (Spotify, Apple Music, YouTube Music, Amazon Music, Tidal, Deezer, Pandora) to import your favorites and export playlists.
- **Share sessions** with a public read-only link.
- **Upgrade to the paid tier** for an ad-free experience and two-device access (see Section 5).
The Service is provided "as is" and may change over time. We may add, remove, or modify features without prior notice.
3. Your account and responsibilities
When you create an account you agree to:
- **Provide accurate information.** Your email must be one you actually control; we use it for verification, security notices, and receipts.
- **Keep your password confidential.** You are responsible for everything that happens under your account, including charges, until you notify us of a compromise.
- **Notify us promptly of unauthorized use.** Email security@rockgod.app the moment you suspect your account has been accessed without your permission.
- **One person, one account.** You may not create multiple accounts to circumvent the guest-tier rate limits or the two-device limit on the paid tier.
- **Comply with your streaming providers' terms.** When you connect Spotify, Apple Music, etc., their terms also govern your use of their data. We respect the OAuth scopes you grant and never request more than the minimum we need.
4. Acceptable use
You may not use the Service to:
- **Abuse, harass, or harm others.** This includes sending abusive content via shared session pages or in any other place the Service exposes user-generated input.
- **Scrape or systematically extract data.** Our public endpoints exist to serve users, not to be re-aggregated. Automated requests beyond reasonable personal use are prohibited.
- **Resell, rebrand, or commercially redistribute the Service** without our written permission.
- **Reverse-engineer, decompile, or disassemble** any part of the Service except to the extent that applicable law expressly permits.
- **Attempt to defeat the IP-slot limit on the paid tier** — for example by routinely using VPNs to rotate addresses. We allow legitimate VPN use; we don't allow using one to share a paid account with friends.
- **Use the Service to violate applicable law** — copyright, intellectual property, export controls, sanctions, defamation, or any other law that applies to you.
- **Probe, scan, or test the security of the Service** without prior written authorization. Responsible disclosure of security issues is welcome at security@rockgod.app.
- **Upload or share content that is illegal, infringing, or harmful.** Session titles and any other free-text inputs are subject to this rule.
We may suspend or terminate accounts for any of the above (see Section 11).
5. Paid upgrade
The Service offers a one-time paid upgrade.
- **Price:** **US$10.00**, one-time, billed in full at checkout. Pricing may change for new purchases, but anyone who has already paid the original price keeps the benefits they purchased.
- **What you get:** an **ad-free experience for life on the current Phase-1 feature set**, and access from **two registered IP addresses** ("IP slots ip1 and ip2"). You may release and re-assign IP slots from _Account → Devices_ at any time.
- **What "for life" means:** as long as the Service continues to operate and as long as your account remains in good standing. We will give at least 60 days' notice via email if we ever discontinue the paid features. "For life" applies to the Phase-1 feature set defined when you purchased; we will not retroactively put existing features behind a new paywall, but new optional features added in later phases may require a separate purchase.
- **Payment processing:** payments are handled by Stripe, Inc. Your card data is sent directly to Stripe and never touches our servers. Your purchase is governed by Stripe's terms in addition to ours.
- **No refunds.** Because the upgrade is a one-time digital purchase that unlocks benefits immediately, **all sales are final**. We do not issue refunds, including pro-rated refunds, for any reason — including discontinuation of features, loss of streaming-service partnerships outside our control, or change of mind. EU/UK consumers retain any non-waivable statutory withdrawal rights; to exercise them, contact billing@rockgod.app within 14 days of purchase and **before** you have used the paid feature set. Once you have used the paid features, you have actively requested early performance and waived the 14-day right of withdrawal.
- **Chargebacks:** initiating a chargeback may result in account suspension. If you believe a payment was made in error, please contact billing@rockgod.app first; we'd rather resolve it directly than through your card network.
6. Intellectual property
- **Our intellectual property.** The Service — including its source code, design, user interface, "The Rock God" name and logo, and all related materials — is owned by Rock God and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
- **Your data is yours.** You retain ownership of the content you submit (session inputs, session titles, custom playlist names). You grant us a worldwide, royalty-free license to use, store, and process that content **solely for the purpose of operating the Service** — for example, generating recommendations, rendering session pages, and creating playlists at your direction. This license ends when you delete the content or close your account.
- **Public shared sessions.** When you share a session via the public share link, you grant us permission to display that session to anyone who has the link. You can disable a share at any time by deleting the session.
- **Feedback.** If you send us suggestions or feedback, you grant us a perpetual royalty-free license to use it without obligation. Feedback is not confidential unless you mark it as such and we agree in writing.
7. Third-party services
The Service integrates with third-party APIs and services that are outside our control:
- **Last.fm** for music-similarity data.
- **Streaming providers** — Spotify, Apple Music, YouTube Music, Amazon Music, Tidal, Deezer, Pandora — for favorite imports and playlist exports.
- **Stripe** for payments.
- **Resend** for email.
- **Heap.io** for analytics.
- **AWS** for hosting.
We are not responsible for the availability, accuracy, content, or terms of those third-party services. If a streaming provider revokes its API, changes its terms, or rate-limits us in a way that breaks a Service feature, we will adapt as best we can but cannot guarantee uninterrupted access. The paid-tier "ad-free for life" benefit is **not** contingent on any specific streaming provider remaining available.
8. Disclaimers
THE SERVICE IS PROVIDED **"AS IS" AND "AS AVAILABLE"** WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We do not guarantee:
- That recommendations will match your taste.
- That third-party data (Last.fm, streaming providers) is accurate, complete, or current.
- Any specific level of uptime, latency, or throughput.
- That the Service will be available in your jurisdiction or on your device.
Some jurisdictions do not allow exclusions of implied warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- **No indirect damages.** Rock God shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenues, lost data, or business interruption — arising out of or related to the Service, even if we have been advised of the possibility.
- **Cap on direct damages.** Rock God's total cumulative liability to you for all claims arising out of or related to the Service is limited to the **greater of (a) US$50 or (b) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim**.
These limits apply regardless of the legal theory (contract, tort, statute, or otherwise) and form an essential basis of the bargain between us. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages; in those jurisdictions, the above limits apply to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Rock God and its officers, employees, and contractors from any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:
- Your breach of these Terms.
- Content you submit or share through the Service.
- Your violation of any law or third-party right.
We will notify you of any claim subject to this indemnity and may, at our option, control the defense.
11. Suspension and termination
- **By you.** You may close your account at any time via _Account → Delete account_. After a 90-day soft-delete window (see the Privacy Policy), all your data is purged.
- **By us.** We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms — including the Acceptable Use rules in Section 4 — or if we are required to do so by law. Where the violation is correctable and not severe, we'll generally email you first and give you a chance to fix it.
- **Effect of termination.** Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution) will survive.
12. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. Material changes to the Terms (such as changes to dispute resolution, refund policy, or paid-tier benefits) will be communicated via email and an in-app notification at least **30 days** before they take effect, except where an immediate change is required by law or to address a security issue.
By continuing to use the Service after a change becomes effective, you accept the updated Terms. If you do not accept, please stop using the Service and (if applicable) delete your account.
13. Governing law and dispute resolution
These Terms are governed by the laws of **the State of _[Your State]_, United States** (placeholder pending finalization of incorporation), without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in _[Your County, Your State]_, and you and we both consent to the personal jurisdiction of those courts. **Class actions and class arbitrations are not permitted.**
EU and UK consumers retain the right to bring claims in the courts of their country of residence.
14. Miscellaneous
- **Entire agreement.** These Terms (together with the Privacy Policy) are the entire agreement between you and Rock God regarding the Service and supersede any prior agreement.
- **Severability.** If any provision is held unenforceable, the rest of the Terms remains in effect.
- **No waiver.** Our failure to enforce any provision is not a waiver of our right to enforce it later.
- **Assignment.** You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- **Notices.** We may send legal notices to the email on your account; you should send notices to legal@rockgod.app.
- **Force majeure.** Neither party is liable for failure to perform caused by events outside its reasonable control (acts of God, war, internet outages, third-party API failures, etc.).
